Vinpearl Golf Membership Regulations

1. Introduction

Vinpearl Joint Stock Company (“Company”) owns and/or manages, operates and runs for business purposes a golf course system nationwide, including Vinpearl Golf Nha Trang, Vinpearl Golf Phu Quoc, Vinpearl Golf Hai Phong, Vinpearl Golf Nam Hoi An and other future courses (“Golf Courses”). The Company established Vinpearl Golf Club (“the Club”), managing and issuing all kinds of “Membership Cards” giving certain benefits and offers for the Members, in order to create an enjoyable playground for Members and Guests with the best care and support services. These Vinpearl Golf Membership Regulations” with the following specific rules and regulations are intended to provide a safe and stable environment and protect the interests of Members and Guests at the Golf Courses. Guests and Members should understand and comply with the Golf Course Rules to ensure safety while golfing and using other services,adhere to the code of conduct, and respect the culture, courtesy, and sportsmanship of golf.

2. Management Policy

2.1. Management Board

The operation and management of the Club will be subject to the control of the Company through the Management Board with a team of executives and technical and other professional staff to solve any problems related to the Club. The term “Management Board refers to any individual or organization appointed by the Company as a Manager for the Club.

2.2. Authority to Amend Regulations and Apply Exceptions 

The Company and/or the Management Board may reserve or apply exceptions to any provision of these Regulations. 

Decisions made by the Company and/or the Management Board on any arising issues shall be deemed final and binding on all Members, Guests, and other related parties.

3. Members

3.1. Members are individuals or companies who wish to join the Club, having agreed upon these Regulations, completed the required Club membership procedures, and being granted a Membership Card by Vinpearl Golf in accordance with regulations.

3.2. Depending on the Club’s development, Member requirements, and/or management demands, the Company may issue different types of Membership Cards with varying terms, applicable conditions, and policies from time to time.

3.3. The registration, renewal, and transfer of Membership Cards are subject to the relevant procedures and fee schedule issued by the Management Board and/or the Company from time to time.

4. Responsibilities of Members

4.1. To fully pay their membership fees and other charges for services and facilities at the Golf Course in accordance with the Golf Course rules and regulations from time to time

4.2. To commit to consistently adhering to the Golf Course rules and regulations

4.3. To always accompany their guests to the Golf Course, be responsible for their behavior and conduct, and remind them to comply with the Golf Course rules and regulations

4.4. To present their Membership Cards when using services at the Golf Course

4.5. To follow the course operator’s instructions regarding the teeing ground and pace of play 

4.6. To immediately report to the Management Board any loss of Membership Cards and to obtain a new one after paying a fee.

5. Membership Termination

Membership may be terminated at the discretion of the Golf Course upon any of the following:

5.1. Proper assignment of a Membership Card

5.2. A Member’s severe or repeated (3-time onwards) violation of these Regulations and Golf Course rules and regulations. For the avoidance of doubt, a serious violation means an irreparable violation and/or a violation of the law

5.3. The dissolution, bankruptcy, or termination of operations of the Company owning the Membership Card 

6. Membership Inheritance

6.1. If an individual member passes away, the Company shall facilitate the assignment of his/her membership to his/her legal heir. The heir must submit an application for the membership assignment together with the Membership Card, the will, and relevant documents to the Management Board.

 

6.2. The heir shall pay the fees for the renaming procedures specified by the Company at the time of assignment and fully pay any outstanding fees of the Member.

 

6.3. When there are multiple heirs, only one heir can obtain the Membership.

 

6.4. The procedures for assigning the Membership Card mentioned in Article 6.1 hereof must be done within 1 (one) year from the date of the individual Member’s death, otherwise the Membership will be revoked and no longer be inherited.
